Terms of Service
Last updated: June 21, 2026
Acceptance of Terms
These Terms of Service govern your use of Fins & Ferns, operated by [Business legal name] at [Business address]. By accessing or using the service, you agree to these terms and to the related Privacy Policy, Refund Policy, and Cancellation Policy.
Service Description
Fins & Ferns is a web-based 3D aquascape designer. The service lets users design aquarium layouts, save designs, share public links, export PNG images, upload custom assets, and use platform-provided plants, hardscape, and premium/pro assets.
Account Registration
Some features require an account created with email or supported OAuth providers. You are responsible for keeping your account credentials secure and for activity under your account. The service is not directed to children under 13 or the age of digital consent in your location.
Free and Pro Plans
The Free plan includes access to the designer, PNG export, limited saved designs, limited public sharing, and basic assets. Pro includes unlimited saves, unlimited shares, custom asset uploads, and access to premium/pro assets. Plan limits may be enforced in the application and database.
Pro availability
Pro is coming soon. Payments, recurring subscriptions, and self-service billing are not currently available. Any future paid service will be presented with its price and applicable terms before purchase.
User-Created Aquascape Designs
You retain ownership of the aquascape designs you create. You grant Fins & Ferns permission to store, process, render, and display your designs as needed to provide the service. If you share a design publicly, anyone with the link may view it.
User-Uploaded 3D Assets
You retain ownership of 3D assets you upload. You represent that you have the rights needed to upload and use those files. The service may store encrypted or processed copies so they can appear in the designer. You are responsible for the legality and accuracy of uploaded content.
Shared and Public Designs
Shared designs are public to anyone who has the link. You may make a shared design private or delete it where the app provides those controls. Public designs may be eligible for future community-gallery features, subject to your plan and sharing settings.
Acceptable Use
- Do not upload illegal, infringing, abusive, or harmful content.
- Do not spam, scrape, overload, or interfere with the service.
- Do not impersonate others or misrepresent your rights to uploaded assets.
- Do not reverse engineer protected asset delivery, encryption, or access-control systems.
Asset and License Restrictions
Platform-provided free and premium/pro assets are licensed for use inside Fins & Ferns. They may not be redistributed, extracted, resold, or used outside the service unless a separate license permits it. User-uploaded assets remain the property of the uploading user or their rightful owner.
Future paid services
There are currently no paid plans to cancel or refund. The pricing page shows which features are available today and which are planned.
Service Availability
The service is provided as is and as available. Features may change, maintenance may occur, and access may be interrupted. Fins & Ferns does not guarantee uninterrupted availability or that every feature will remain available indefinitely.
Limitation of Liability
To the fullest extent permitted by law, Fins & Ferns and [Business legal name] are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Maximum liability is limited to the amount you paid for the service in the 12 months before the claim.
Termination
You may stop using the service or request account deletion. Fins & Ferns may suspend or terminate access for violations of these terms, legal risk, abuse, or nonpayment. Data may be deleted after termination, subject to legal, tax, and operational retention requirements.
Governing Law
These terms are governed by the laws of [Governing law/state/country], without regard to conflict of law principles. Disputes will be handled in the courts or forums applicable in that jurisdiction.
